To submit a reservation form for a trip from our website, you must read and accept these terms and conditions as binding to the contract. Please read them carefully and thoroughly. No reservation form will enter our booking system without prior acceptance of these terms and conditions by the client.

 

 

Agents and Representatives
Moto Map Travel agents and representatives only represent us; they are not part of this contract and are not responsible or liable for any failure that occurs during the provision of the service as described in the contract text.

 

 

Reservations and Deposits
At the time of booking a Tour, a deposit is required, varying depending on each tour. This deposit secures a place on the Tour. Spaces are limited, and acceptance is on a first-come, first-served basis with deposits. The balance will be charged 30 days before the Tour's start date. The rental period will not be interrupted due to the renter's inability to ride or for any other reason. During the tour, Moto Map Travel is not obliged to replace a crashed motorcycle.

Own Motorcycle
When a tour participant uses their own motorcycle, Moto Map Travel does not provide any insurance.

The Tour price includes everything listed on the information page for that Tour on our website.

 

 

Tour Price Does Not Include
Anything not mentioned as included on the Tour information page and personal expenses.

 

 

Accommodation in Rooms
There are a limited number of single rooms available at an additional cost, assigned on a first-come, first-served basis, but availability is not guaranteed for all requests. If you are traveling alone but wish to stay in a double room, Moto Map Travel will attempt to find you a roommate in the same situation. If Moto Map Travel cannot find a roommate, the single room supplement must be paid by the participant.

 

 

Renter's Responsibility for Damages
From the delivery of the motorcycle until its return, the renter is responsible to the landlord for even the slightest negligence or lack of care in case of disappearance (including loss and confiscation) of the motorcycle and any damage (such as an accident, operational damage, damage resulting from improper use, or damage reducing the motorcycle's value) occurring beyond normal use during the rental period. In case of damage to the rented motorcycle, the renter will be responsible for the repair costs, determined by an expert report which the renter will also pay for, and the reduction in the motorcycle's technical and market value based on the deductible chosen. The burden of proof for any damage lies with the renter.
In the event of damage to the rented motorcycle, the renter will be responsible for the cost of the repair, which will be determined by an expert report that the renter will also pay for, as well as the reduction in the technical and market value of the motorcycle based on the deductible depending on the type of insurance chosen. Cancellations and Refunds Without Cancellation Insurance
If the renter cancels their reservation, the landlord will refund the full amount if the cancellation occurs more than 30 days in advance and 50% if it occurs between 15 and 30 days in advance. If the cancellation occurs less than 15 days in advance, no refund will be given. If the renter picks up the motorcycle later than the reserved date but before the end of the reservation period, they can use it until the reservation end date without any refund for the days not used.

 

 

Custom Tours
Moto Map Travel can organize custom tours for individuals or groups. These tours will be designed according to the specifications provided by the individual or the group leader. If a custom tour needs to be canceled or rescheduled after Moto Map Travel has already designed it: – If the trip has not yet started: a) If we are more than 60 days before the tour's start, Moto Map Travel reserves the right to keep the deposit as credit for a future tour with the same design within 2 years. b) If we are less than 60 days before the tour's start, Moto Map Travel will keep 100% of the tour cost as credit for a future tour with the same design within 2 years. – If the tour has already started and must be interrupted, Moto Map Travel will keep the proportional part of the unused portion of the trip as credit for a future tour within 2 years.

 

If the trip has not yet started
a) If we are more than 60 days before the start of the tour, Moto Map Travel reserves the right to keep the charged deposit as credit to be used for a future tour, with the same design, within a period of 2 years.
b) If we are less than 60 days before the start of the tour, Moto Map Travel will keep 100% of the tour cost as credit to be used for a future tour, with the same design, within a period of 2 years.

If the tour has already started and must be interrupted, Moto Map Travel will keep the proportional part of the unused portion of the trip as credit to be used for a future tour within 2 years.

 

Minimum Number of Participants
Moto Map Travel may cancel the tour two weeks before its start if the minimum number of participants has not been reached. In this case, customers will be notified immediately and will receive a full refund of what they have paid or credit for a future tour within 2 years.

 

 

Tour Cancellation
Force Majeure
In the event that the tour cannot start or has to be suspended once it has started due to force majeure reasons beyond the control of Moto Map Travel and beyond the control of the clients, such as natural disasters, strikes, global health alerts, war, this is the policy of Moto Map Travel:

If the trip has not yet started
a) If we are more than 30 days before the start of the tour, Moto Map Travel reserves the right to keep the charged deposit as credit to be used for a future tour within a period of 2 years.
In cases of force majeure, if the Tour cannot start or must be suspended once started due to reasons beyond Moto Map Travel's control and the clients' control, such as natural disasters, strikes, global health alerts, war, Moto Map Travel’s policy is: – If the trip has not yet started: a) If more than 30 days before the tour's start, Moto Map Travel reserves the right to keep the deposit as credit for a future tour within 2 years. b) If less than 30 days before the tour's start, Moto Map Travel will keep 100% of the tour cost as credit for a future tour within 2 years. – If the tour has already started and must be interrupted, Moto Map Travel will keep the proportional part of the unused portion of the trip as credit for a future tour within 2 years.

Traffic Law Disobedience
Moto Map Travel Tours are formed by motorcycle lovers worldwide. Moto Map Travel understands that people will have different skill levels, beliefs, and political ideologies. It is crucial on every Moto Map Travel Tour that all members respect other group members to maintain a positive atmosphere for everyone. If Moto Map Travel deems that a member negatively affects the tour group dynamics by (but not limited to): riding dangerously, not complying with traffic laws or group travel requirements, being rude, being confrontational, deliberately provoking others, etc., and hindering others' enjoyment of the tour, Moto Map Travel reserves the right to remove the member from the tour without refund. If the client disobeys traffic laws or group travel requirements, Moto Map Travel may cancel the contract, and the rented motorcycle will be directly charged to the client.

If the client does not comply with the current traffic laws or the requirements for group travel, the contract may be canceled by Moto Map Travel, and the rented motorcycle will be taken back under their responsibility.

 

Passport, VISA, and Traffic and Health Regulations
The client is obliged to comply with these regulations and will be responsible for all consequences if they fail to do so.

 

 

Liability
Moto Map Travel is responsible for providing services according to the information on their website for each tour. Moto Map Travel selects and closely monitors all its contractors, such as hotels and restaurants. Moto Map Travel is responsible for the organization and preparation of the trip. Moto Map Travel is not responsible for any kind of accident. Moto Map Travel reserves the right, without prior notice, to cancel any part of the tour or the entire tour, to make as many changes as it deems necessary, and any additional costs, if any, must be paid by the tour participants.
Moto Map Travel is responsible for providing services according to the information on their website regarding each Tour. Moto Map Travel selects and monitors all contractors, such as hotels and restaurants, carefully. Moto Map Travel is responsible for the trip's organization and preparation. Moto Map Travel is not liable for any accidents. Moto Map Travel reserves the right to cancel any part of the Tour or the entire Tour without prior notice, make any necessary changes, and any additional costs, if any, must be borne by the tour participants. It is also agreed and understood that the owners, operators, and agents of this Tour, including Moto Map Travel, are not responsible for the safety of their clients, and therefore, individually or collectively, cannot be held liable for any incident related to the Tour operation or the client's participation in the Tour, which results in injury, death, or any other damage to the client, their property, family, descendants, or heirs. Moto Map Travel is not responsible for delays caused by external reasons in delivering the motorcycles on time. Moto Map Travel is not responsible for lost or stolen items from our rental centers or support vehicles. Moto Map Travel is not responsible for delays or changes in the program or other conditions.

Tour Program Changes
Tours are operated based on seasons, and if a change in seasons or weather conditions causes a change in the Tour's development and accommodations, the itinerary will be adjusted to the situation, using alternative hotels, roads, and restaurants.

 

 

Tour, Rental, and Motorcycle Costs
These are calculated based on current exchange rates at the time of tariff publication and are subject to change depending on international currency fluctuations and inflation. They can be adjusted by Moto Map Travel up to 30 days before the tour's start date, which will be the final payment date.

 

 

Moto Map Travel Offers
All Moto Map Travel promotions and discounts are calculated from the published base price for the rider and passenger on any tour and the published base rental price of any motorcycle.

 

Photos and Audiovisual Material
All photos, videos, and audiovisual material produced by Moto Map Travel during a tour are the property of Moto Map Travel. The copyright belongs to Moto Map Travel.

Moto Map Travel, as the owner of this material, reserves the right to use it for advertising or marketing purposes, including images where clients can be identified and recognized, without needing their prior authorization or consent and being exempt from any claim for using this material. This right would be voided if the client expressly requests not to use photographs in which they appear. This request will only be valid if issued before the Tour starts.

 

Insurance
Moto Map Travel recommends purchasing adequate travel, health, and accident insurance before starting the Tour.

 

 

Verbal Changes
Verbal contract changes are invalid unless Moto Map Travel confirms them in writing.

 

 

Printing Errors
Moto Map Travel reserves the right to correct printing or editing errors and calculation errors at any time.

 

 

GENERAL TERMS AND CONDITIONS FOR RENTALS

These rental conditions are an integral part of the contractual agreement between MOTO MAP TRAVEL, S.L (Lessor) and the client (Lessee) regarding the use of the motorcycle. Any clarification, change, or supplement to these terms will only be valid if made in writing.

RENTAL AGREEMENT The object of the contractual agreement with Moto Map Travel is exclusively the temporary transfer of the reserved motorcycle. The lessee must organize and carry out their trip according to their preference and use the motorcycle responsibly. Unless otherwise agreed in writing, all prices include unlimited mileage, insurance as chosen, and VAT.

MILEAGE LIMIT
For rentals lasting 1 to 6 days, mileage is not unlimited, with a limit of 300 km/day. Once this limit is exceeded, the additional kilometer price will be €0.35 per kilometer.

 

RESERVATION AND PAYMENT
All reservations require a valid VISA or MasterCard credit card. After service confirmation, the agreed amount will be charged to the provided credit card. The prepayment amount to reserve the motorcycle is 30% of the total rental amount. The prepayment ensures the motorcycle reservation. The rental balance will be charged to the same card 30 days before the first rental day.

 

MINIMUM DURATION
The minimum rental duration is 1 day from Monday to Friday (non-holidays). For weekends, a minimum of 2 days is required, with pickup on Friday afternoon and return on Monday morning (non-holiday).

 

 

AVAILABILITY GUARANTEE
After the reservation payment, the lessee will receive a confirmation via email. This guarantees the availability of the reserved motorcycle. Moto Map Travel reserves the right to replace the chosen rental motorcycle at any time due to unforeseen circumstances. Moto Map Travel will endeavor to ensure that the lessee drives the confirmed motorcycle. Unfortunately, unforeseen and uncontrollable situations sometimes occur, including but not limited to mechanical breakdowns, collision damage, and theft. If Moto Map Travel cannot replace the confirmed motorcycle with an identical or similar one, the customer will be refunded the difference in service cost. This constitutes Moto Map Travel's maximum liability. Even if the motorcycle is returned by the lessee before the rental period has ended, the total amount agreed upon in the contract will be charged.

 

 

  1. Cancellation (Total or Partial) and Date Changes
    If the cancellation (total or partial) by the lessee is made more than 30 days before the rental period, the full amount will be refunded. If made between 30 and 15 days, 50% of the total rental payment will be refunded. No refund will be made if done less than 15 days in advance.

The rental date can be changed once. To be valid, the change must be notified at least one working day in advance. The new date must be informed at the time of the change and must be within 12 months from the first day of the original rental. This service carries a 20% surcharge of the total rental cost, always with a minimum of 100 euros.

Force Majeure
If the rental cannot take place or must be suspended once started due to force majeure beyond the control of Moto Map Travel and the customers, such as natural disasters, prolonged strikes, global health alerts, or war, Moto Map Travel's policy is:
If the rental has not yet started, Moto Map Travel reserves the right to keep the amount paid by the customer at the time of cancellation and apply it in full as a credit that the customer can use for a future rental.
If the rental has started and must be interrupted midway, Moto Map Travel reserves the right to keep the total amount paid by the customer and apply the proportional part of the unused rental days as a credit that the customer can use for a future rental.

 

  1. Renter's Obligations

The lessee must use the motorcycle carefully and attentively, respecting the appropriate technical codes to ensure safe driving. The lessee must comply with all legal requirements, particularly all traffic regulations. The lessee is responsible for complying with all traffic laws and regulations and must have a valid passport, travel insurance,

 

Prohibited Actions for the Renter

  1. Allowing unauthorized persons to use the motorcycle.
  2. Allowing unqualified individuals or those without a valid driver's license or in an inappropriate state to drive the motorcycle.
  3. Driving the motorcycle without being qualified or having a valid driver's license.
  4. Using the motorcycle in inappropriate conditions.
  5. Using the motorcycle for commercial purposes.
  6. Participating in any motorcycling events, including practices or free sessions.
  7. Using the motorcycle off-road.
  8. Pawning or selling the motorcycle, parts, equipment, accessories, and documentation in any way that infringes the landlord's property rights or any other right over the motorcycle.
  9. Taking the motorcycles to African countries like Morocco.

 

  1. OBLIGATIONS AND RESPONSIBILITIES OF THE LESSOR

The lessor commits to maintaining and delivering the motorcycle in a technically acceptable state to ensure safe driving. The lessee must also receive the vehicle's documents and tools. The lessor must acknowledge and accept existing damages on the motorcycle only if they are recorded on the damage sheet at the time of delivery. If a repair is necessary during the rental period to ensure the motorcycle's proper functioning, the lessee must receive the lessor's explicit permission before making any repairs. Any subsequent claims are excluded unless the damage or loss to the lessee is attributed to significant negligence by the lessor.

 

  1. Renter's Responsibility for Damage

From the moment of delivery until the return of the motorcycle, the lessee is responsible to the lessor even in the case of the slightest negligence or lack of care in case of disappearance (including loss and confiscation) of the motorcycle and any damage (such as an accident or operational damage, damage resulting from inappropriate use, or damage that reduces the motorcycle's value) that occurs beyond normal use of the motorcycle during the rental period. The burden of proof for even the slightest damage lies with the lessee.

 

  1. Requirements in Case of Accident or Damage

If damage or loss occurs, as in the case of an accident, the lessee must notify the lessor immediately by phone. Moto Map Travel will charge the customer's provided credit card for the repair amount according to the contracted insurance type. In the event of an accident, it must be immediately reported to the police. Evidence (such as road marks) must be preserved, and persons involved in the accident must be identified. The lessee must do everything necessary to facilitate and contribute to clarifying the sequence of events. ASSISTANCE WITH COURIER SERVICE

Moto Map Travel offers to assist clients who request it in contracting a courier service for the shipment of their luggage or packages from our rental points. This courier service is provided by an independent company unrelated to Moto Map Travel.

Moto Map Travel only acts as an intermediary between the client and the courier company and is not responsible for delays in delivery, damage, or loss of the shipped material.

In case of loss, damage, or delay during the shipping process, the client must file the appropriate claim with the contracted courier company, and Moto Map Travel is free of any liability.

 

  1. Insurance Coverage

The renter agrees to assume financial responsibility up to the amount chosen in their insurance option (basic or VIP) in case of damage to the motorcycle. The credit card information in the Moto Map Travel rental contract will be used as a guarantee for the insurance deductible payment (depending on the chosen insurance type). The renter specifically understands that, although the motorcycle has insurance, they are entirely responsible for all damages and payment in the following cases:

  1. If any requirements in the "Renter's Obligations" section are not met.
  2. If the accident scene is abandoned.
  3. If damage is caused intentionally, deliberately, or due to significant negligence.
  4. Exceeding the agreed rental period in the contract.

The basic insurance included in the rental rate is third-party insurance for the vehicle, including the following:
Third-party coverage with driver accidents and travel assistance.

Mandatory third-party liability coverage for up to €50,000,000 per accident.

Driver assistance limited to €900 for medical assistance, within 365 days from the accident date, in public health centers in Spain and private centers agreed upon and published by Unespa and the General Directorate of Insurance and Pension Funds in the BOE.

Death indemnity for the driver: €6,000.

Permanent disability indemnity: Up to €6,000 (depending on the disability degree).

The driver is the only vehicle occupant insured.

These clauses may become invalid in the following cases:
The vehicle driver drives under the influence of alcohol, toxic drugs, narcotics, or psychotropic substances.

The driver takes the vehicle to unauthorized places by the renting company, such as off-road, forest tracks, or unpaved roads, and circuits.

 

  1. Motorcycle Return

The motorcycle must be returned without any visible external deficiencies. The lessee must return the motorcycle in these conditions at the end of the agreed rental period, at the agreed place and time, with all vehicle documents, accessories, and tools. The lessor is authorized to terminate the rental agreement without notice if there is a significant reason that makes the continuation of the contract unacceptable. These reasons include, in particular, false personal information provided by the lessee or incorrect payment information, as well as serious violations of the agreements stipulated in the rental agreement. In the case of termination of the contract without notice, the motorcycle must be returned immediately, even if the rental period has not yet ended. The lessor's rights to claim damages and compensation are not affected by this situation.

 

  1. Traffic Violations and Toll ResponsibilityThe lessee assumes financial responsibility for traffic violations and all toll expenses during the rental period. The management of each violation or fine, as well as any unpaid toll, will incur an administrative cost of €30.

 

 

  1. Charges for Pickup and Return Outside of Business Hours

The lessee agrees to a charge of €30 per motorcycle for both pick-up and return outside Moto Map Travel's business hours (weekends, national and local holidays). This charge will be paid directly to the agent who delivers or collects the motorcycle outside Moto Map Travel's business hours. Moto Map Travel's business hours are Monday to Friday from 9:00 am to 1:30 pm and from 3:00 pm to 6:30 pm.

 

 

INSURANCE
Moto Map Travel recommends purchasing adequate travel, health, and accident insurance and trip cancellation insurance.

 

 

PRINTING AND CALCULATION ERRORS
Moto Map Travel reserves the right to correct printing and calculation errors at any time.

 

 

ILLEGAL USE OF MOTO MAP TRAVEL MATERIAL

All material appearing on the Moto Map Travel website, Moto Map Travel's tour manuals, and Moto Map Travel's motorcycle maps/routes are protected by international copyright laws and are the property of Moto Map Travel. They may not be copied, reproduced, distributed, published, displayed, performed, modified, created into derivative works, transmitted, or exploited in any way, nor distributed any part of this content through any network, sold, or offered for sale, or used to build any type of database. Copying or storing any content is expressly prohibited, except as provided above, without the prior written permission of Moto Map Travel.
