GENERAL TERMS AND CONDITIONS FOR TOURS

Tour Operator The Tour Operator is Moto Map Travel S.L., located at Calle Comte D’Urgell 95 bis, Barcelona.
To submit a trip booking form through our website, you are required to read and accept these terms and conditions as binding for the contract. We ask that you read them carefully.
No booking form will reach our reservation system unless the client has previously accepted said terms and conditions.

Agents and Representatives
The agents and representatives of Moto Map Travel merely represent us but are not parties to this contract, nor are they in any case responsible or liable for any failure that may occur during the provision of the service as described in the contract text.

Bookings and Deposits
At the time of booking a Tour, a deposit is required, which varies depending on each tour. This deposit secures a spot on the Tour. Spots are limited, and acceptance is based on a first-come, first-served basis regarding bookings with deposits. The remaining balance will be charged 30 days before the start of the Tour.
The rental period will not be interrupted due to the renter’s inability to ride a motorcycle or for any other reason. During the tour, Moto Map Travel is not obliged to replace a motorcycle involved in an accident.

Own Motorcycle
When a tour participant brings their own motorcycle to use on the Tour, Moto Map Travel does not provide any type of insurance for them.

Tour Price Includes

The Tour price includes everything listed on the specific Tour information page on our website.

Tour Price Does Not Include

Everything not mentioned as included on the Tour information page, as well as personal expenses.

Room Accommodation
There is a limited number of single rooms available for an additional fee, which will be assigned on a first-come, first-served basis; however, availability cannot be guaranteed for all requests.
If you are traveling alone but wish to stay in a double room, Moto Map Travel will try to find you a roommate traveling in the same situation. If Moto Map Travel cannot find a roommate for you, the single room supplement must be paid by said participant.

RENTER’S LIABILITY FOR DAMAGE
From the moment of motorcycle delivery until its return, the renter is liable to the lessor even in the case of the slightest negligence or lack of care regarding disappearance (including loss and confiscation) of the motorcycle, as well as any damage (such as an accident, operational damage, damage resulting from improper use, or damage that reduces the motorcycle’s value) occurring beyond the limits of normal motorcycle use during the rental period
In the event of damage to the rented motorcycle, the renter will be responsible for the repair cost, the value of which will be established by an expert report which the renter must also pay for, and for the reduction in the technical and market value of the motorcycle based on the deductible applicable depending on the chosen insurance type. The burden of proof for even the slightest damage shall rest with the renter.

Cancellationas and refounds without cancellation insurance
If the renter cancels their booking, the lessor will refund the full amount if the cancellation occurs more than 30 days in advance, and 50% if the cancellation occurs between 15 and 30 days in advance. If the cancellation occurs less than 15 days in advance, the renter will not be entitled to any refund.
If the renter arrives to pick up the motorcycle at a date later than the reserved date, but prior to the end date, they may use it until the reservation end date, without being entitled to any refund for the days the motorcycle was not used.

Custom tours
Moto Map Travel is able to organize custom tours for both individuals and groups. These custom tours will be designed according to the specifications provided by the individual or, in the case of groups, the group leader. If a custom tour has to be canceled or rescheduled after Moto Map Travel has already designed it:

– If the trip has not yet started:
a) If it is more than 60 days before the start of the tour, Moto Map Travel reserves the right to keep the collected deposit as credit to be used on a future tour, with the same design, within a period of 2 years.
b) If it is less than 60 days before the start of the tour, Moto Map Travel will keep 100% of the tour cost as credit to be used on a future tour, with the same design, within a period of 2 years.

– If the tour has already started and must be interrupted:
Moto Map Travel will keep the proportional part of the unused portion of the trip as credit to be used on a future tour within a period of 2 years.

Minimum number of tour participants
Up to two weeks before the start of the Tour, Moto Map Travel may cancel the tour if a sufficient number of participants has not been reached for said Tour. In this case, customers will be notified immediately and will be fully refunded the amount they have already paid, or it will be kept as credit to be used on a future tour within a period of 2 years.

Tour cancellation
Force Majeure Cases
In the event that the Tour cannot begin or must be suspended once started, due to force majeure reasons beyond the control of Moto Map Travel and beyond the control of the customers, such as natural disasters, strikes, global health alerts, war, this is Moto Map Travel’s policy:

– If the trip has not yet started a) If it is more than 30 days before the start of the tour, Moto Map Travel reserves the right to keep the collected deposit as credit to be used on a future tour within a period of 2 years. b) If it is less than 30 days before the start of the tour, Moto Map Travel will keep 100% of the tour cost as credit to be used on a future tour within a period of 2 years.

– If the tour has already started and must be interrupted:
Moto Map Travel will keep the proportional part of the unused portion of the trip as credit to be used on a future tour within a period of 2 years.

Disobedience of traffic laws and country regulations

Moto Map Travel Tours is made up of motorcycle lovers from all over the world. Moto Map Travel understands that people will have different riding skill levels, different beliefs, and political ideologies. It is paramount on every Moto Map Travel Tour that all tour members are respectful of other group members to maintain a positive atmosphere for all tour participants.
If Moto Map Travel considers that a tour member is having a negative effect on the tour group dynamics due to (but not limited to): dangerous riding, failure to comply with traffic laws or group travel requirements, being rude, being conflictive, deliberately provoking others in the group, etc., and is hindering the enjoyment of others on the tour, Moto Map Travel reserves the right to remove the member from the tour without refund.

If the customer does not respect the current traffic laws or the requirements for group travel, the contract may be canceled by Moto Map Travel and the rented motorcycle will become their sole responsibility.

Passport, VISA, and traffic and health regultions
The customer is obligated to comply with and abide by said regulations and will be responsible for all consequences in case of failure to do so.

Liability

Moto Map Travel is responsible for providing the services in accordance with the information appearing on its website regarding each Tour. Moto Map Travel selects and closely monitors all its contractors, such as hotels and restaurants. Moto Map Travel is responsible for the organization and preparation of the trip. Moto Map Travel is not responsible for any type of accident. Moto Map Travel reserves the right, without prior notice, to cancel any part of the Tour or the Tour in its entirety, and to make as many changes as it considers necessary; any extra costs, if they exist, must be paid by the tour participants.
It is also agreed and understood that the owners, operators, and agents of this Tour, including Moto Map Travel, are not responsible for nor guardians of their customers’ safety, and therefore, they, individually or collectively, cannot be held responsible for any incident related to the operation of the Tour or the client’s participation in the Tour that results in injury, death, or any other damage to the client, their property, their family, their descendants, or their heirs.
Moto Map Travel is not responsible for delays caused by reasons beyond its control regarding the timely delivery of motorcycles. Moto Map Travel is not responsible for items lost or stolen from our rental centers or support vehicles. Moto Map Travel is not responsible for delays or changes in the schedule or other conditions.

Alteriations to the tour schedule
Tours are operated based on the seasons, and if a seasonal alteration or weather condition causes a change in the development of the Tour and accommodations, the itinerary will be adjusted to the situation, and alternative hotels, roads, and restaurants will be used.

Tour prices, rental prices, and motorcycle costs
These are calculated based on the exchange rates in effect at the time of publishing our rates and are subject to change depending on international currency fluctuations and inflation, and may be adjusted by Moto Map Travel up to 30 days before the start of the tour, which will be the final payment date.

Moto Map Travel Offers
All Moto Map Travel promotions and discounts are calculated based on the published base price for rider and passenger on any tour, and based on the published base price for any motorcycle rental.

Photos and audiovisual material
All photos, videos, and audiovisual material produced by Moto Map Travel during a tour are the property of Moto Map Travel. The copyright belongs to Moto Map Travel.

Moto Map Travel, as the owner of said material, reserves the right to use it for advertising or marketing purposes, including images in which its customers may be identified and recognized, without needing their prior authorization or consent, and remaining exempt from any claim for the use of said material. This right would be annulled in the case of an express request by the customer not to use photographs in which they appear. This request will only be valid if issued before the start of the Tour.

Insurance
Moto Map Travel recommends that you purchase adequate travel, health, and accident insurance before starting the Tour.

Verbal changes
“Verbal changes to the contract are not valid unless Moto Map Travel confirms them in writing.

Printing errors
Moto Map Travel reserves the right to correct printing or editing errors, as well as calculation mistakes, at any time.

GENERAL RENTAL TERMS AND CONDITIONS

These rental conditions constitute a constitutive part of the contractual agreement between MOTO MAP TRAVEL, S.L. (Lessor) and the client (renter), regarding the use of the motorcycle.
Any clarification, change, or supplement to these terms shall only be valid if made in writing.

The object of the contractual agreement with Moto Map Travel is exclusively the temporary transfer of the reserved motorcycle. The renter must organize and conduct their trip according to their preference and must use the motorcycle responsibly. Unless otherwise agreed in writing, all prices include unlimited mileage, insurance (according to the chosen option), and VAT.

MILEAGE LIMIT
In the case of rentals of 1 to 6 days in duration, mileage will not be unlimited, with a limit of 300 km/day. Once this limit is exceeded, the price for each additional kilometer will be €0.35 per kilometer.

BOOKING AND PAYMENT
All bookings require a valid VISA or MasterCard credit card. After service confirmation, the agreed amount known to both parties will be charged to the provided credit card.
The prepayment amount to reserve the motorcycle is 30% of the total amount representing the full rental. The prepayment secures the motorcycle reservation. The remaining balance of the rental total will be charged to the same card 30 days before the first day of the rental.

MINIMUM DURATION
The minimum rental duration is 1 day from Monday to Friday (non-holidays). For weekends, a minimum duration of 2 days is established, with pick-up on Friday afternoon and return on Monday morning (non-holiday).

AVAILABILITY GUARANTEE
After payment of the reservation, the renter will receive a confirmation via email. This is the guarantee of availability of the reserved motorcycle. Moto Map Travel reserves the right to substitute the motorcycle chosen for rental at any time, provided it is due to circumstances that could not be foreseen. Moto Map Travel will endeavor to ensure that the renter rides the motorcycle that has been confirmed. Unfortunately, sometimes unforeseeable and uncontrollable situations occur. This includes, but is not limited to, mechanical breakdowns, collision damage, and theft.
If Moto Map Travel is unable to replace the confirmed motorcycle with an equal or similar one, the customer will be refunded the amount corresponding to the difference in service. This constitutes Moto Map Travel’s maximum liability. Even if the motorcycle is returned by the renter before the rental period has ended, the total amount agreed in the contract will be charged.

  1. Cancellation (total or partial) and date changes
    If the cancellation (total or partial) by the renter is made more than 30 days before the rental period, the full amount will be refunded. If it is made between 30 and 15 days, 50% of the total rental payment will be refunded. If it is made less than 15 days in advance, no type of refund will be made.

It is possible to change your rental date only once. To be valid, notice of the change must be given at least one business day in advance. The new selected date must be informed at the time of the change and must be within the 12 months following the first day of the original rental. THIS SERVICE INCURS A SURCHARGE OF 20% OF THE TOTAL RENTAL AMOUNT, ALWAYS WITH A MINIMUM OF €100.

Force Majeure Cases In the event that the rental cannot take place or must be suspended once started, due to force majeure reasons beyond the control of Moto Map Travel and beyond the control of the customers, such as natural disasters, prolonged strikes, global health alerts, war, this is Moto Map Travel’s policy:
– If the rental has not yet started, Moto Map Travel reserves the right to keep the amount paid by the customer at the time of cancellation and apply it in its entirety as a credit that the customer may use on a future rental.
– If the rental has started and must be interrupted halfway, Moto Map Travel reserves the right to keep the total amount paid by the customer, and apply the proportional part of the rental days not enjoyed as a credit that the customer may use on a future rental.”

  1. RENTER’S OBLIGATIONS

The renter must use the motorcycle carefully and attentively, respecting the appropriate technical codes of use to ensure safe riding. The renter must comply with all legal requirements and especially all traffic regulations. The renter is responsible for abiding by all traffic laws and regulations and for meeting the following requirements: having a valid passport, travel insurance, a European Union driving license, or a valid international permit for the duration of the stay. The renter will be responsible for paying all fines or administrative penalties attributed to their use of the motorcycle during their rental period.

It is prohibited for the renter:

  1. To allow any person who has not been previously authorized in the rental contract to use the motorcycle.
  2. To allow persons who are not capable of driving, or who do not possess a valid driving license, or who are in an inappropriate state for driving, to use the motorcycle.
  3. To drive the motorcycle themselves without being capable of doing so or without having a valid driving license.
  4. To use the motorcycle in inappropriate conditions.
  5. To use the motorcycle for commercial purposes.
  6. To participate with the motorcycle in motorcycling events of any kind, including practice runs, trials for these events, or open track days (tandas libres).
  7. To use the motorcycle off-road.
  8. To pawn or sell the motorcycle in whole or in parts, equipment, accessories, and documentation, in any way that infringes upon the lessor’s property rights or any other right they may have over the motorcycle.
  9. To take the motorcycles to African countries such as Morocco.

  1. OBLIGATIONS AND LIABILITY OF THE LESSOR

The lessor agrees to maintain and deliver the motorcycle in a technically acceptable condition to ensure safe riding. The renter must also receive the vehicle documents and tools. The lessor must acknowledge and accept existing damage to the motorcycle only if it has been recorded on the damage sheet at the time of motorcycle delivery.
If, even if not the lessor’s fault, a repair is necessary during the rental period to ensure the proper functioning of the motorcycle, the renter must receive explicit permission from the lessor before carrying out any repair. Any subsequent claims are excluded unless the damage or loss for the renter is attributed to gross negligence on the part of the lessor.

  1. RENTER’S LIABILITY FOR DAMAGE

  1. REQUIREMENTS IN CASE OF ACCIDENT OR ANY OTHER DAMAGE

If damage or loss occurs, just as in the case of an accident, the renter is obliged to notify the lessor immediately by telephone. Moto Map Travel will charge the credit card provided by the customer for the repair amount according to the contracted insurance type. In the case of an accident, it must be reported immediately to the police. Evidence (such as skid marks on the road) must be preserved, and persons involved in the accident must be identified. The renter must do everything necessary to facilitate and contribute to clarifying the sequence of events.

Moto Map Travel offers to help customers who request it to hire a courier/parcel service to ship their suitcases or packages from our rental locations. This courier/parcel service is performed by an independent company unrelated to Moto Map Travel.

Moto Map Travel acts only as an intermediary between the client and the courier company and shall in no case be held responsible for delays in the delivery of the sent material, nor for the damage or loss thereof.

In the event of loss, damage, or delay arising during the material shipping process, it will be the client themselves who must file the claim they consider appropriate against the courier company contracted to carry out the shipment, leaving Moto Map Travel free of any liability.”

  1. INSURANCE COVERAGE

The renter agrees to assume financial responsibility, up to the amount chosen in their insurance option (basic or VIP), in the event of damage to the motorcycle. The credit card information on the contract with Moto Map Travel for the motorcycle rental will be used as a guarantee for the payment of the insurance deductible (depending on the chosen insurance type). The renter must specifically know that, even if the motorcycle has insurance, they are fully responsible for all damages and responsible for their payment in the following cases:

  1. If they fail to comply with any of the requirements stipulated in the ‘Renter’s Obligations’ section.
  2. If they leave the scene of an accident in which they have been involved.
  3. If they cause damage intentionally, deliberately, or due to gross negligence.
  4. If they exceed the rental period agreed in the contract.

The basic insurance included in the rental rate is third-party vehicle insurance that includes the following:
– Third-party coverage with driver accident insurance and travel assistance.

– Mandatory civil liability coverage for third parties involved in case of an accident. Covering both vehicles and their drivers and occupants up to €50,000,000 per claim.

– Assistance to the vehicle driver limited to €900 for medical/healthcare assistance, within a period of 365 days from the day of the accident in public health centers in Spain and those private centers agreed upon by Unespa and the Directorate General of Insurance and Pension Funds and published in the BOE.

– Compensation for driver’s death: €6,000.

– Compensation for permanent disability: A maximum of €6,000 (depending on the degree of disability).

– The driver is the only occupant of the vehicle who is insured.

These clauses may become invalid in the following cases:
– The vehicle driver drives under the influence of alcoholic beverages, toxic drugs, narcotics, or psychotropic substances.

– The driver takes the vehicle to places not authorized by the rental company, in this case, off-road, forest tracks, or any unpaved road, and race tracks.

  1. MOTORCYCLE RETURN

The motorcycle must be returned without any visible external deficiency. The renter must return the motorcycle in these conditions at the end of the agreed rental period, at the agreed location and time, with all vehicle documents, accessories, and tools. The lessor is authorized to terminate the rental contract without prior notice if there is a compelling reason that makes the continuation of the contract unacceptable. These reasons include, in particular, false personal data of the renter or incorrect payment information, as well as serious violations of the agreements stipulated in the rental contract. In the case of contract termination without prior notice, the motorcycle must be returned immediately, even if the rental period has not yet ended. The lessor’s rights to claim for damages caused and compensation are not affected by this situation.

  1. TRAFFIC INFRACTIONS AND TOLL LIABILITY
    The renter assumes financial responsibility for traffic infractions, as well as all toll expenses incurred during the entire rental period. The management of each infraction or fine, as well as any unpaid toll, will carry a cost of €30 for administrative expenses.

  1. OUT-OF-HOURS PICK-UP AND DROP-OFF CHARGES

The renter accepts the charge of €30 per motorcycle for both pick-up and return outside of Moto Map Travel’s business hours (weekends, national and local holidays). This charge will be paid directly to the agent carrying out the delivery or pick-up of the motorcycle outside of Moto Map Travel’s business hours. Moto Map Travel’s business hours are Monday to Friday from 9:00 to 13:30 and from 15:00 to 18:30.

INSURANCE
Moto Map Travel recommends that you purchase adequate travel, health, and accident insurance, as well as trip cancellation insurance.

PRINTING AND CALCULATION ERRORS
Moto Map Travel reserves the right to correct printing and calculation errors at any time.

ILLEGAL USE OF MOTO MAP TRAVEL MATERIAL

All material appearing on the Moto Map Travel website, Moto Map Travel tour manuals, and Moto Map Travel motorcycle maps/routes are protected by international copyright laws and are the property of Moto Map Travel. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works, transmit, or in any way exploit any such content, nor distribute any part of this content over any network, sell or offer it for sale, or use such content to construct any kind of database.
Copying or storing any content is expressly prohibited, except as provided above, without the prior written permission of Moto Map Travel. To obtain permission to publish content, please contact

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April – General Data Protection Regulation – MOTO MAP TRAVEL SL, domiciled at C/ COMTE D’URGELL, 95 BIS, 08011 BARCELONA, informs you that the data you have provided to us will become part of a personal data processing inventory, for which said entity is responsible, with the purpose of sending you commercial and advertising information about our products and services through any means, including electronic ones.

To exercise your rights of access, rectification, opposition, deletion, limitation, and portability recognized by current legislation, please send a communication to the address C/ COMTE D’URGELL, 95 BIS, 08011 BARCELONA, attaching a copy of your National Identity Document or equivalent identification document.
