GENERAL RENTAL TERMS AND CONDITIONS
These rental conditions are a constituent part of the contractual agreement between MOTO MAP TRAVEL, S.L. (Lessor) and the client (Lessee), regarding the use of the motorcycle. Any clarification, change, or supplement regarding these terms shall be valid only if made in writing.
The object of the contractual agreement with Moto Map Travel is exclusively the temporary transfer of the reserved motorcycle. The lessee must organize and conduct their trip according to their preference and must make responsible use of the motorcycle. Unless otherwise agreed in writing, all prices include unlimited mileage, insurance (depending on the chosen option), and VAT.”
KILOMETER LIMIT
For rentals lasting 1 to 6 days, mileage is not unlimited, with a limit of 300 km/day. Once this limit is exceeded, the price of the additional kilometer will be between €0.30 and €0.40 per kilometer depending on the model.
RESERVATION AND PAYMENT
All reservations require a valid VISA or MasterCard credit card. After confirmation of the service, the rental amount will be charged to the provided credit card for the amount agreed upon and known by both parties. Upon motorcycle pick-up, a security deposit of €600 or €1500 (depending on the motorcycle model) will be blocked on the credit card.
MINIMUM DURATION
The minimum rental duration is 1 day. The stipulated pick-up and return times are 10:00 am and/or 6:00 pm from Monday to Friday. Outside of these hours, there are additional costs stipulated in the rental agreement.
AVAILABILITY GUARANTEE
After payment of the reservation, the renter will receive a confirmation via e-mail. This is the guarantee of availability of the reserved motorcycle. Moto Map Travel reserves the right to substitute the motorcycle chosen for rental at any time, provided that it is due to circumstances that could not be foreseen. Moto Map Travel will endeavor to ensure that the renter drives the motorcycle that has been confirmed. Unfortunately, sometimes some unforeseeable and uncontrollable situations occur. This includes, but is not limited to, mechanical breakdowns, collision damage, and theft. If Moto Map Travel is unable to replace the confirmed motorcycle with an equal or similar one, the customer will be refunded the amount that differentiates the service. This constitutes the maximum responsibility of Moto Map Travel. Even if the motorcycle is returned by the renter before the rental period has ended, the total amount agreed in the contract will be charged.
2. Cancellation (total or partial) and change of dates
If the cancellation (total or partial) by the renter is made more than 30 days before the rental period, the full amount will be refunded. If it is made between 30 and 15 days, 50% of the total rental payment will be refunded. If it is made less than 15 days in advance, no refund will be made.
It is possible to change the date of your rental only once. To be valid, the change must be notified at least one business day in advance. The new date chosen must be reported at the time of the change and must be within 12 months from the first day of the original rental. THIS SERVICE CARRIES A SURCHARGE OF 20% OF THE TOTAL OF YOUR RENTAL ALWAYS WITH A MINIMUM OF 100 EUROS.
Cases of force majeure
In the event that the rental cannot be carried out or has to be suspended once started, for reasons of force majeure beyond the control of Moto Map Travel and beyond the control of the clients, such as natural disasters, prolonged strikes, global health alerts, war, this is the policy of Moto Map Travel:
- If the rental has not yet started, Moto Map Travel reserves the right to keep the amount paid by the client at the time of cancellation and apply it in full as a credit that the client may use in a future rental.
- If the rental has started and must be interrupted halfway through, Moto Map Travel reserves the right to keep the total amount paid by the client, and apply the proportional part of the rental days that have not been enjoyed, as a credit that the client may use in a future rental.
3. OBLIGATIONS OF THE RENTER
The renter must make careful and attentive use of the motorcycle, respecting the appropriate technical codes of use to ensure safe driving. The renter must comply with all legal requirements and especially all traffic regulations. The renter is responsible for complying with all traffic laws and regulations and for meeting the following requirements: having a valid passport, travel insurance, a European Union driving license, or a valid international permit for the duration of the stay. The renter will be responsible for paying all fines or administrative penalties that are attributed to their use of the motorcycle during their rental period.
The renter is prohibited from:
a. Allowing any person who has not been previously authorized in the lease agreement to use the motorcycle.
b. Allowing people who are not qualified to drive, or who do not have a valid driving license or who are in a state not suitable for driving.
c. Driving the motorcycle himself or herself, without being qualified to do so or without having a valid driving license.
d. Making use of the motorcycle in inappropriate conditions.
e. Making use of the motorcycle for commercial purposes.
f. Participating with the motorcycle in motorcycling events of any kind, including practices or trials of these events or free rounds.
g. Making use of the motorcycle off-road, except for exceptions stipulated in the rental agreement.
h. Pledging or selling the motorcycle in its entirety or in parts, equipment, accessories and documentation, in any way that infringes the property rights of the lessor or any other right that it has over the motorcycle.
i. Taking the motorcycles to African countries such as Morocco, except for exceptions stipulated in the rental agreement.
4. OBLIGATIONS AND RESPONSIBILITY OF THE LESSOR
The lessor undertakes to maintain and deliver the motorcycle in a technically acceptable condition to ensure safe driving. The lessee must also receive the vehicle documents and tools. The lessor must recognize and accept existing damage to the motorcycle only if these have been recorded on the damage sheet at the time of delivery of the motorcycle. If, although not the fault of the lessor, a repair is necessary during the rental period to ensure the proper functioning of the motorcycle, the lessee must receive the explicit permission of the lessor before making any repair. Any subsequent claims are excluded unless the damage or loss to the lessee is attributed to a significant negligence on the part of the lessor.
5. RESPONSIBILITY OF THE RENTER FOR DAMAGE
From the moment of delivery of the motorcycle until the moment of return of the motorcycle, the renter is liable to the lessor even in the event of the slightest negligence or lack of care in the event of disappearance (including loss and confiscation) of the motorcycle as well as any damage (such as an accident or operational damage, damage resulting from improper use or damage that reduces the value of the motorcycle) that occurs beyond the limits of normal use of the motorcycle during the rental period. In case of damage to the rented motorcycle, the renter will be responsible for the cost of the repair, the value of which will be established by an expert report which the renter will also pay, and the reduction of the technical and market value of the motorcycle based on the deductible that has depending on the type of insurance chosen. The burden of proof of the slightest damage will fall on the renter.
6. REQUIREMENTS IN CASE OF ACCIDENT OR ANY OTHER DAMAGE
If damage or loss occurs, as in the case of an accident, the renter is obliged to notify the lessor immediately by telephone. Moto Map Travel will charge the amount of the repair to the credit card provided by the customer according to the type of insurance contracted. In the event of an accident, it must be reported immediately to the police. The evidence (such as marks on the road) must be preserved, and the people who have been involved in the accident must be identified. The renter must do everything necessary to facilitate and contribute to a clarification of the sequence of events.
Moto Map Travel offers to help, those customers who request it, to contract a courier/parcel service for the shipment of their suitcases or packages from our rental points. This parcel/courier service is carried out by an independent company unrelated to Moto Map Travel.
Moto Map Travel only acts as an intermediary between the client and the parcel company and in no case will be responsible in the event of delays in the delivery of the material sent, nor for the damage or loss of the same.
In case of loss, damage, or delay that arises during the shipping process of the material, it will be the client himself who will have to file the claim that he deems appropriate to the parcel company contracted to make the shipment, leaving Moto Map Travel free of any responsibility.
7. VEHICLE INSURANCE COVERAGE
The renter agrees to assume financial responsibility, up to the amount according to the model selected in case of damage to the motorcycle. The credit card information contained in the contract with Moto Map Travel for the rental of the motorcycle will be used as a guarantee of payment of the insurance deductible (according to the motorcycle model selected) in the form of a block at the time of motorcycle pick-up. The renter must know specifically that, although the motorcycle has insurance, he is fully responsible for all damages and is responsible for their payment in the following cases:
a. If you do not meet any of the requirements stipulated in the section “Obligations of the renter”.
b. If you leave the scene of the accident in which you have been involved.
c. If you cause damage intentionally, deliberately or due to significant negligence.
d. Exceed the rental period agreed in the contract.
The basic insurance included in the rental rate is third-party insurance for the vehicle that includes the following:
- Coverage to third parties with accidents to the driver and travel assistance.
- Mandatory civil liability coverage to third parties involved in the event of an accident. Both of the vehicles and their drivers and occupants of up to €50,000,000 per claim.
- Assistance to the driver of the vehicle limited to €900 for medical-health assistance, with a period of 365 days from the day of the accident in public health centers in Spain and those private centers that Unespa and the General Directorate of Insurance and Pension Funds have agreed and published in the BOE.
- Compensation for death of the driver: €6,000.
- Compensation for permanent disability: A maximum of €6,000 (will depend on the degree of disability).
- The driver is the only occupant of the vehicle who is insured.
- These clauses may cease to be valid in the following cases:
- The driver of the vehicle drives under the influence of alcoholic beverages, toxic drugs, narcotics or psychotropic substances.
- The driver takes the vehicle through places not authorized by the leasing company, in this case by field, forest tracks or any unpaved road, and circuit.
8. RETURN OF THE MOTORCYCLE
The motorcycle must be returned without any visible external deficiencies. The renter must return the motorcycle in these conditions at the end of the agreed rental period, at the agreed place and time, with all the documents, accessories and tools of the vehicle. The lessor is authorized to terminate the lease agreement without prior notice if there is a valid reason that makes the continuity of the contract unacceptable. These reasons include in particular, false personal data of the renter or incorrect information of their data for payment, as well as serious violations of the agreements stipulated in the lease agreement. In the event of termination of contract without prior notice, the motorcycle must be returned immediately, even if the rental period has not yet ended. The rights of the lessor to claim damages and compensation are not affected by this situation.
9. TRAFFIC VIOLATIONS AND TOLL RESPONSIBILITY
The renter assumes financial responsibility for traffic violations, as well as all toll expenses that occurred during the entire period of their rental. The management of each infraction or fine, as well as any non-payment of toll will carry a cost of €30 for administrative expenses.
10. CHARGES FOR PICK-UP AND RETURN OUTSIDE OF HOURS
The renter accepts the charge of 30 euros per motorcycle both for pick-up and return outside of Moto Map Travel business hours (weekends, national and local holidays). This charge will be paid directly to the agent who makes the delivery or collection of the motorcycle outside of Moto Map Travel business hours. Moto Map Travel business hours are Monday to Friday from 9 to 13:30 and from 15 to 18:30 hours.
INSURANCE
Moto Map Travel recommends that you take out adequate travel, health and accident insurance, as well as travel cancellation insurance. Moto Map offers its customers a VIP insurance that covers both for €25/day
PRINTING AND CALCULATION ERRORS
Moto Map Travel reserves the right to correct printing and calculation errors at any time.
ILLEGAL USE OF MOTO MAP TRAVEL MATERIAL
All material appearing on the Moto Map Travel website, Moto Map Travel tour manuals and Moto Map Travel motorcycle maps/routes are protected by international copyright laws and are the property of Moto Map Travel. Such content may not be copied, reproduced, distributed, published, displayed, performed, modified, used to create derivative works, transmitted or exploited in any way, nor may any part of this content be distributed through any network, sold or offered for sale, or used to build any type of database. Copying or storing any content, except as provided above, without the prior written permission of Moto Map Travel is expressly prohibited.
